Respected Sir,

Sub: - Anomaly and disadvantage to the employee on retirement, who are born on 1st day of             the month.

We like to draw your kind attention to the following facts –

       i.          As per provisions of the service rule in RRB sector, an employee retires on attaining superannuation on completion of sixty years of age.
     ii.          An employee who is born on 1st day of the month will retire on last day of the previous month.
    iii.          In India Gregorian calendar and Indian Standard Time (IST) is followed in official system since 1957 and a day runs between 12:00 a.m. morning to the stroke of 12:00 at midnight covering 24 hours.
   iv.          Birth time is not mentioned generally in Birth Certificate.
     v.          If an employee was born on 1st day of November, he will be retired on 31st October as per the provision under service regulation. But he will attain 60 years of age at the stroke of 12:00 midnight on 31st October when the day is completed. So the employee does not attain 60 years on 31st October when he is relieved at the close of business on 31st October. So he cannot be relieved also before completion of the age of 60 years, he should be and can be released at the beginning or close of office hours on 1st day of the month.
   vi.          The concerned regulations, if read carefully will appear to be not consistent with main spirit of the fixation of age of retirement.



Adverse impacts of retiring an employee on previous day of the month –

         i.          The employee is denied one day’s wages/salary for the 1st day i.e. date of birth.
       ii.          The employee is denied increment in the wage scale if it falls due on 1st.
     iii.          The employee is denied one days’ PL (Privilege Leave) in spite of completing 11 days service on 1st.
     iv.          The employee is denied wage revision in case the revision takes place from 1st.
       v.          The employee is denied gratuity of one year even if he completes 6 months on 1st.
     vi.          The employee is denied pension weightage of one year if he completes 6 months on 1st.

It is understood that incase of the employee of the Central Government and other PSUs, when retired on last day of the previous month, a letter is issued to that effect and all admissible service and retirement benefits upto the 1st of the month are allowed to the employee. This fact can be easily ascertained and verified, Sir.

Under the above context, may we request you Sir, to kindly look into the matter and issue suitable instructions so that RRB employees who are being retired “on the previous day”, may not be deprived of their legitimate due on the above grounds.
